Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Emporiqa website, mobile applications, customer service channels and any related services (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.
1. Parties and definitions
"Emporiqa", "we", "us" and "our" refer to Emporiqa GmbH, a limited liability company organised under the laws of the Federal Republic of Germany, with its registered office at Friedrichstrasse 200, 10117 Berlin, Germany, registered in the commercial register of Amtsgericht Berlin-Charlottenburg under HRB 234567 B, VAT identification number DE123456789, represented by its managing director Anna Schmidt. "You" and "Customer" refer to the natural or legal person accessing the Services. "Consumer" has the meaning given in Directive 2011/83/EU.
2. Eligibility
You must have the legal capacity to enter into a binding contract under the law of your residence. By placing an order you confirm that the information you provide is accurate and complete. Certain age-restricted items (e.g. some accessories) may only be sold to persons aged 18 or above; this is indicated on the relevant product page.
3. Account responsibilities
You are responsible for keeping your account credentials confidential and for any activity carried out under your account. Notify us immediately at [email protected] if you suspect unauthorised use.
4. Orders and contract formation
Product listings on the Services are an invitation to treat. A binding contract of sale is formed when you receive our order confirmation email. We may decline or cancel any order — for example in cases of suspected fraud, manifest pricing errors or stock unavailability — with a full refund of any amounts already taken.
5. Pricing and product information
Prices are shown in EUR and include applicable VAT for EU destinations. If we identify a manifest error in price or specification, we will contact you before dispatch and you may confirm at the corrected terms or cancel without charge.
6. Delivery, risk and title
Risk of loss passes to you (or, for consumers, on delivery to the address you provide, in line with Art. 20 of Directive 2011/83/EU). Title passes once we have received payment in full. Delivery times are estimates; see our Shipping Policy for details.
7. Right of withdrawal and returns
EU/EEA consumers benefit from a 14-day right of withdrawal under Directive 2011/83/EU. Emporiqa extends this to 30 days as a goodwill gesture for most products. 8. Statutory guarantee and voluntary warranty
All goods sold by Emporiqa to consumers carry the EU 24-month legal guarantee of conformity under Directive (EU) 2019/771 on the sale of goods, transposed into German law in §§ 434 et seq. BGB. During the first 12 months, lack of conformity is presumed to have existed at delivery unless we prove otherwise. Many products also carry an additional manufacturer warranty, described on the product page.
9. Right to repair
Where products fall under Directive (EU) 2024/1799 (Right to Repair, applicable from 31 July 2026), Emporiqa cooperates with manufacturers to facilitate repair information access and spare-parts availability. See the Sustainability page for our repair commitments.
10. Acceptable use
You agree not to use the Services for any unlawful purpose, to scrape or systematically extract content, to attempt to compromise security, to reverse-engineer our software, or to upload malicious code.
11. Intellectual property
All content on the Services, including text, graphics, logos, photographs, product descriptions and software, is owned by Emporiqa GmbH or its licensors and protected by EU and international intellectual property law. You may view, download and print pages for personal, non-commercial use only.
12. Limitation of liability
To the maximum extent permitted by law, Emporiqa is not liable for indirect, incidental, special or consequential losses, including loss of profits, data or goodwill. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, for any other liability that cannot be limited or excluded under mandatory law, or under the German Product Liability Act. The statutory rights of consumers remain unaffected.
13. Force majeure
We are not liable for delays or failure to perform our obligations caused by events outside our reasonable control.
14. Dispute resolution and governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence (Art. 6 Rome I Regulation). The place of jurisdiction for B2B disputes is Berlin, Germany; consumers retain their home jurisdiction protections under the Brussels I bis Regulation (EU) No 1215/2012.
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/. Emporiqa is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration body.
15. Changes to these Terms
We may update these Terms to reflect changes in the law or our Services. The current version is always available on this page; material changes are notified by email at least 30 days before they take effect.
